This Policy describes the information gathering and dissemination practices for SportZwave and the website at www.sportzwave.com (the “Site”) as they relate to all Site users (collectively, the “Users”). By visiting or using the Site, you agree to be bound by all of the terms and conditions contained in this Policy. If you do not agree with this Policy, please do not visit or use the Site. This Policy is part of and subject to the Terms of Use Agreement, as applicable.

SportZwave only collects personally identifying information (also known as personally identifiable information) on and through the Site voluntarily and/or with Users’ express permission. All personally identifying information provided to SportZwave will be held in strict confidence and will not be shared with, sold to, or rented to any third parties, except as otherwise disclosed to or agreed by Users.

SportZwave may ask Users to provide certain types of personally identifying information upon use of certain services provided through the Site. The information collected will only be used by SportZwave for purposes of (a) exercising its rights and fulfilling its obligations in accordance with the Terms of Use Agreement, and contacting Users in connection with the same; (b) tracking User behavior; (c) protecting SportZwave and its Users from fraud, error, and other criminal activities; (d) collecting internally demographic, marketing, and promotional information; (e) preventing illegal or inappropriate use of the Site; and (f) collecting fees owed to SportZwave. SportZwave will not collect personally identifiable information from Users who visit the Site but do not use any of the services provided through the Site.

At any time, Users may ask to review or update any of their maintained personally identifying information by contacting us at info@sportzwave.com, however, SportZwave does not represent or warrant that it shall maintain the personally identifiable information provided to it and may permanently delete or discard such personally identifiable information, in whole or in part, at any time. To protect the security and integrity of Users’ information, SportZwave will also take reasonable steps to verify Users’ identity before providing access or correction.

SportZwave may collect and store certain general, non-personally identifying demographic information, as well as information about use of the Site, including but not limited to volumes of sales and other transactions performed through the Site, types and categories of products sold, and information about how Users found out about SportZwave. SportZwave will use this information for marketing and promotional purposes only.

A cookie is a piece of data stored on your computer and tied to information about you. SportZwave may use "cookies" on certain pages of the Site to, among other things, help analyze our web page trends, measure effectiveness, and provide a personalized experience. You are always free to decline our cookies if your browser permits, although in that case you may not be able to use certain features on the Site.

SportZwave does not own or operate any third-party websites that may be accessible through the Site. Some third-party websites may use cookies, log files, clear gifs, or other tracking methods on their own websites. SportZwave does not share in or have access to any of the cookies or other information gathered by third-party websites, and does not in any way limit the use of cookies, log files, clear gifs, or other tracking methods by third-party websites.

Advertisements appearing on the Site may be delivered to Users by third party advertising partners (the “Advertisers”). Information about Users’ visits to the SportZwave site, such as the number of times they have viewed an ad (but not their name, address, or other personal information) may be used to serve ads to Users on this site.

C. Log Files

SportZwave may log and use your I.P. (Internet Protocol) address, browser type, internet service provider, referring/exit pages, platform type, date/time stamp, and number of clicks in order to analyze trends, administer the site, track Users’ movement in the aggregate, gather broad demographic information, and to help diagnose and maintain SportZwave servers. I.P. addresses are not linked to personally identifying information.

Advertisers may use a software technology commonly known as “clear gifs” or “web bugs” that assist in management of site content by providing information to the operator of the site regarding the effectiveness of content. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web users. The main difference between cookies and clear gifs is that clear gifs are invisible on the page and very small in size, about the size of a period at the end of a sentence.

Clear gifs can “work with” existing cookies on a computer if they are both from the same website or advertising company, and therefore may be used to match a clear gif’s identifier with an advertiser’s cookie, which may or may not permit the website or advertising company to personally identify the User.

SportZwave does not use or originate its own clear gifs on any portion of the SportZwave website.

SportZwave will take all reasonable measures in order to protect the loss, misuse, and/or alteration of all proprietary data under our control, including any personally identifying information. In the event that any personally identifying information is submitted to SportZwave, SportZwave may maintain all or some of the personally identifying information in a retrievable form and shall use all reasonable means to ensure that the information is protected both online and off-line. All proprietary information in SportZwave’s possession, including any and all User information, is restricted in SportZwave’s offices and is not publicly accessible, and all employees are kept up-to-date on SportZwave’s security and privacy practices; all such information stored in any remote location, such as on a remote server, is protected from unauthorized access by the use of passwords, encryption, and other commercially-available means of data security. Any time new privacy or security policies are added or modified, all employees are reminded of the importance that SportZwave places on User privacy and are required to familiarize themselves with the new policies.

Though SportZwave is committed to preserving your privacy and does not disclose personally identifying information without your knowledge or consent, SportZwave may need to disclose certain information it has collected, including information gathered via log file, when required by law to comply with a current judicial proceeding, a court order, or legal process served on SportZwave.

SportZwave may share aggregated, non-personally identifying demographic information with business partners and advertisers in order to provide products and services that are tailored to User interests. This information is not linked by SportZwave to any personally identifying information.

SportZwave may share Site usage and general demographic information with reputable third party advertisers for the purpose of providing targeted advertisements on the Site. Information shared and collected with third party advertisers is not personally identifying.

In the event SportZwave goes through a business transition, such as a merger, acquisition, or sale of all or substantially all of its assets, any and all information owned by SportZwave, in most instances, will be a portion of the assets transferred or sold. In such instances, you will be notified via e-mail or regular mail and, to the extent allowed by law, provided a meaningful opportunity to control the sharing of their information with any outside party.

SportZwave may contain links to external websites not affiliated with or owned by SportZwave. Please be aware that SportZwave is not responsible for the privacy practices of such other external websites. We encourage our Users to be aware of when they leave or are accessing websites outside of SportZwave, and to read and familiarize themselves with the privacy statements and policies of those websites that collect personally identifying information.

SportZwave reserves the right to modify or change this Policy after providing all of its affected Users a meaningful opportunity to opt-out or otherwise prevent any material new uses of their personally identifiable information. SportZwave shall provide all affected Users direct notice of such changes by way of U.S. mail and/or email. Any changes to this Policy will also be conspicuously posted on the Site.
